The SEC's proposed Best Interest Regulation applies to recommendations to participants, including rollovers, but apparently does not apply to advice to plans. On the other hand, the proposed Interpretation Regarding Standard of Conduct for Investment Advisers applies to all clients, including plans and participants. It also specifically applies to rollover recommendations. This program discusses the provisions in the proposed Reg BI and RIA Interpretation covering advice to plans and participants, including rollovers. It also discusses other related guidance from the SEC, FINRA and the DOL.
